§ 2 OFFER and CONCLUSION OF CONTRACT
All items supplied in the online shop constitute a non-binding catalogue. A contract between the customer and kleine körbchen (hereinafter “company”) only comes into being when the customer places her order in the online shop and the company accepts it. The company accepts the order by sending an order confirmation by e-mail or by dispatching the merchandise.
§ 3 DELIVERY and PAYMENT
a) Generally speaking, merchandise can be ordered and delivered anywhere in Europe. If the customer wishes an order to be delivered outside Europe, the company will endeavour to find a solution.
b) The delivery time for each item is displayed on the respective web page. If there should be any delay in delivery, we will notify you of this immediately. Should it be impossible to deliver any item, we reserve the right not to deliver it. In this case, we will notify you as quickly as possible and return any performance rendered immediately.
c) Orders are only delivered against payment by SEPA bank transfer prior to shipment or by using the services provided by PayPal PLUS: PayPal, credit card, payment upon invoice or Direct Debit .
d) SEPA bank transfer: If you choose to pay by SEPA bank transfer, please transfer the total invoice amount to our bank account. You will find our account details at the bottom on the invoice which you will receive via e-mail.
Please give your order number as your reference.
e) PayPal, credit card, Direct Debit and Payment upon invoice: This payment methods are realised with the serviced of the payment provider PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, Luxembourg. § 4 CANCELLATION INSTRUCTION
CANCELLATION RIGHT IN GERMANY and the EU
You may cancel this contract within fourteen days without giving a reason. The cancellation deadline is fourteen days from the day on which you or a third party named by you (not the carrier) received the order.

a clear declaration (e.g. by e-mail, a letter sent by post or our cancellation form) of your intention to cancel this contract. For this, you can use the cancellation form enclosed with your order; however, this is not obligatory.
You will be deemed to have met the cancellation deadline if you send the declaration of your intention to exercise your cancellation right before the deadline expires.
CONSEQUENCES OF CANCELLATION
If you cancel this contract, we are obliged to return all the payments we received from you, including delivery costs (except for any additional costs incurred if you requested a delivery method other than the cheapest standard delivery method we offer), within fourteen days of the day on which we received your notification that you are cancelling the contract. We will return your payment using the same method you used for the original transaction unless we expressly agree otherwise in writing; under no circumstances will you be charged any fees for this repayment.
We may refuse to return your payment until we receive the items you ordered or until you provide evidence that you have sent the order back to us, whichever happens first.
In any case, you must send the items back or hand them over to us within fourteen days of the day on which you notified us that you are cancelling this contract. You will be deemed to have met the deadline if you send us the items before the fourteen-day deadline expires. We will bear the cost of returning the goods for returns within the EU.
You will only have to compensate us for any loss of value if this was caused by the items being handled in any other way than that necessary to examine their quality, properties and function.
CANCELLATION RIGHT FOR NON-EU ORDERS
Unlike in the EU, customers in non-EU countries must bear the direct costs of returning the items.
END OF CANCELLATION INSTRUCTION
The cancellation right is void if you were engaging in a commercial activity or acting in your capacity as a self-employed person when you concluded the contract.
§ 5 RETURNS
We will pay the costs of return delivery for you. For this, please request a franked parcel stamp by e-mailing us at email@example.com an. Please ensure that sufficient postage is attached to any returns and make sure they are insured. If items are returned unfranked or without sufficient postage, we reserve the right to invoice you for any additional expense incurred.
§ 6 WARRANTY
The statutory warranty claims apply in the event of any material defects in the merchandise When selling new merchandise to consumers, warranty claims expire two years from the beginning of the statutory limitation period.
§ 7 PRICES
The prices in the online shop are quoted in Euro and include statutory value added tax. The product prices do not include delivery fees.
§ 8 DELIVERY CHARGES
If sending your order with DHL GOGREEN , we charge a flat rate of € 4.95 per delivery address and order to cover postage, packing and delivery within Germany, irrespective of the value of your order.
We can also send your order with dpd, Hermes or UPS if you prefer.
The flat-rate charge for sending your order with dpd is € 4.95 within Germany.
The flat-rate charge for sending your order with Hermes is € 6.50 within Germany.
The flat-rate charge for sending your order with UPS is € 7.90 within Germany.
All prices include statutory value added tax.
We charge a flat rate of € 9.95 per delivery address and order for orders sent to European countries outside Germany, irrespective of the value of your order. Your order will be sent with DHL.
Orders sent outside the EU are also subject to duty and fees that must be paid by the recipient. You can obtain more information from your local customs office. Please also note that if you choose to pay in advance, you may also be charged fees for foreign bank transactions. Paying these is your responsibility. We therefore advise you to pay by PayPal or SEPA transfer. Duty, fees and other handling charges will not be reimbursed if you return the merchandise.
§ 9 RETENTION OF TITLE
The items will remain the property of the company until they have been paid for in full.
§ 10 DISCLAIMER FOR EXTERNAL LINKS
The company’s website contains links to websites operated by other providers. The company expressly declares that it has no influence whatsoever on the design or content of any of these linked web pages. The company herewith expressly distances itself from all content on all web pages operated by other providers that are linked fromwww.kleine-koerbchen.de and does not appropriate any of it.
§ 11 IMAGE RIGHTS
All image rights are held by the company or its partners. They may not be used without the express consent of the company or its partners.
§ 12 DISPUTE RESOLUTION

§ 13 FINAL CLAUSE
Should one or more terms in these General Terms and Conditions be invalid, the validity of the remaining terms will not be affected. The invalid term will be replaced by a valid term that meets the presumed intent of both contractual parties.
